These Terms of Service ("Terms") govern your access to and use of RFP Command (the "Service"), operated by RFP Command ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
Please read these Terms carefully. They include an arbitration clause and class action waiver in Section 13.
By accessing or using the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them along with our Privacy Policy, which is incorporated herein by reference.
We reserve the right to update these Terms at any time. We will provide at least 14 days' notice of material changes via email and in-platform notification. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
RFP Command is a software-as-a-service (SaaS) platform that helps government contractors track, manage, and analyze their bid pipelines across federal, state, and local government procurement opportunities.
The Service includes tools for opportunity tracking, compliance scoring, pipeline analytics, team collaboration, and related features as described at rfpcommand.com/features.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes or discontinuation of core features.
You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the accuracy of your account information and for updating it promptly when it changes.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at hello@rfpcommand.com.
You may not share your account credentials with others. Each individual user must have their own account. Team collaboration is supported through our invited-member workspace model.
If you are an organization administrator, you are responsible for managing your team's access, ensuring your team members comply with these Terms, and for all activity conducted through your organizational workspace. You may add and remove team members within the limits of your subscription plan.

Plan features are as described at rfpcommand.com/pricing. We reserve the right to change pricing with 30 days' notice to existing subscribers.
Paid subscriptions are billed in advance on a monthly or annual basis. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal period.
You may cancel your subscription at any time from your account settings. Upon cancellation, your paid access continues until the end of the current billing period. After that, your account reverts to the Starter plan limits. We do not provide refunds for partial billing periods on monthly plans. Annual plans may be eligible for a pro-rated refund within 14 days of purchase — contact us at hello@rfpcommand.com.
If a payment fails, we will attempt to recharge your payment method up to three times over seven days. If payment is not received, your account will be downgraded to the Starter plan. Your data will be preserved for 90 days, after which it may be permanently deleted if your account remains unpaid.
All prices are exclusive of applicable taxes. You are responsible for any sales, use, VAT, or other taxes imposed by applicable law on your subscription fees.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain full ownership of all data, content, and information you submit to the Service ("Your Content"). We claim no intellectual property rights over Your Content.
By submitting content to the Service, you grant us a limited, non-exclusive, worldwide license to store, process, and display Your Content solely as necessary to provide the Service to you. This license terminates when you delete the content or close your account.
You are solely responsible for Your Content and represent that you have all necessary rights to submit it to the Service. You represent that Your Content does not infringe any third-party intellectual property rights and does not violate any applicable law.
You may export your pipeline data at any time from the platform. We will also provide a complete data export upon request within 30 days of account closure.
We may use aggregated, anonymized, non-personally identifiable data derived from the Service to improve our products, publish research, or analyze market trends — for example, tracking what percentage of users pursue federal vs. state contracts. This data will never identify you or your organization and will never include the specific content of your pipeline entries.
The Service and its original content (excluding Your Content), features, functionality, design, code, and branding are and will remain the exclusive property of RFP Command. The RFP Command name, logo, and all related marks are trademarks of RFP Command.
Nothing in these Terms grants you any right to use our trademarks, service marks, or trade dress without our prior written consent.
Feedback, suggestions, or ideas you provide about the Service ("Feedback") are provided voluntarily. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use any Feedback for any purpose, including incorporating it into the Service, without compensation to you.
We understand that the information you track in RFP Command — your pipeline strategy, bid decisions, compliance documentation, pricing approaches, and competitive intelligence — is sensitive business information.
We treat Your Content as confidential and will not disclose it to any third party except as described in our Privacy Policy or as required by law. Our employees and contractors who have access to user data are bound by confidentiality obligations.
This confidentiality obligation does not apply to information that: (a) is or becomes publicly known through no breach of these Terms; (b) you have explicitly authorized us to share; or (c) we are legally required to disclose.
We do not warrant that:

The compliance checklists, FAR/DFARS references, and certification tracking features are informational tools only and do not constitute legal guidance on whether your submissions comply with applicable procurement law. Consult a qualified government contracts attorney for legal advice.
Our total cumulative liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the amounts you paid to us in the 12 months preceding the claim, or (b) $100.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless RFP Command and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
You may terminate your account at any time by canceling your subscription and requesting account deletion. See Section 4 for billing implications of cancellation.
We may suspend or terminate your account immediately, without prior notice or liability, if:
Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days following termination, during which you may request an export. After 90 days, your data will be permanently deleted. Sections 6 (Your Data — Ownership), 7, 8, 9, 10, 11, 13, and 14 survive termination.
Before filing any formal dispute, you agree to contact us at hello@rfpcommand.com and attempt to resolve the matter informally. We will work in good faith to resolve the issue within 30 days.
If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Montgomery County, Maryland, or by videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm while arbitration is pending. Small claims court actions are also exempt from this arbitration requirement.
These Terms and any dispute related to them or the Service shall be governed by the laws of the State of Maryland, without regard to its conflict of law provisions. Federal courts and state courts located in Montgomery County, Maryland have exclusive jurisdiction over any matter not subject to arbitration.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RFP Command regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. A waiver shall only be effective if made in writing and signed by an authorized representative of RFP Command.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, governmental actions, internet service disruptions, or cyberattacks.
These Terms are for the sole benefit of you and RFP Command and do not create any third-party beneficiary rights.
